Foreign insurance companies have been able to operate freely in the Brazilian insurance market since June 1996, (when the Federal Attorney exempted insurers from the existing limits to foreign capital).

This freedom is now in force, although technically there is still a need for legislative reform to formally change the foreign capital restrictions set out in the Brazilian Constitution. However, foreign insurers have in fact been permitted to set up independently in Brazil and many insurers have done so since 1996.
